I write to you as a constituent. I also write to you as someone who believes that the survivors of the Mother and Baby Homes deserve justice. The Mother and Baby Home survivors suffered some of the worst human rights violations in Ireland in the last century, and the redress scheme as currently drafted lets survivors down yet again.

The Mother and Baby Institutions Payment Scheme Bill 2022 as it stands is a major disappointment that shies away from the State's responsibility to provide adequate remedies for human rights violations. These were State-supported institutions. ICCL has sent you a briefing with more detail, but here is a list of proposed changes to the scheme that would more adequately reflect the ill-treatment suffered:

1. Widen the scheme to all survivors. The exclusion of children who spent less than 6 months in an institution and children who were boarded out is arbitrary, doesn’t recognise the nature of trauma, and may be discriminatory.

2. Remove the legal waiver. The waiver directly takes away survivors' right to access justice and the UN has specifically called for its removal.

3. Increase the compensation available. The tiny amount of redress is in no way proportionate to the  ill-treatment and abuse suffered. What we’re talking about are some of the worst human rights abuses, and you would be compensated more in a whiplash case.

This is an issue I care about deeply. We can and must ensure that the survivors of the Mother and Baby Homes see the justice that they deserve.
